Bad news for immigrants in Mexico seeking asylum in the United States

Contrary to the announcement made by the U.S. administration, the health law commonly known as Title 42 will not be repealed.

A federal judge issued a ruling on Friday that ordered the Biden administration to continue to enforce Title 42, which allows the government to deport illegal immigrants without giving them the opportunity to apply for asylum in the United States.

This measure, which was scheduled to be repealed on May 23, was implemented by former President Donald Trump.

Joe Biden’s team has already announced its intention to appeal the judge’s decision. But this procedure will take several months.

According to Judge Robert Summerhays, who sided with the attorneys general of Arizona, Missouri and Louisiana, “the administration’s decision to terminate Title 42 did not meet the standards set by the Administrative Procedure Act,” as reported by the Times newspaper.

Several Republican and Democratic lawmakers had denounced the Biden administration’s decision to end the health measure for illegal immigrants seeking asylum in the US.
Since the adoption of Title 42 in March 2020 by Donald Trump, more than 1.8 million immigrants have been deported. The vast majority have been intercepted at the southern border, according to the Department of Homeland Security, cited by Time magazine.

Thousands of migrants had already made their way to the U.S.-Mexico border to try their luck on May 23, when Title 42 was scheduled to be repealed by the U.S. government.
